Wisconsin’s Food Aid Caught in Federal Legal Battle

Efforts by the Trump administration to retract food assistance payments have sparked controversy, with Wisconsin Governor Tony Evers labeling the situation as “embarrassing.” This comes after several states, including Wisconsin, distributed November’s Supplemental Nutrition Assistance Program (SNAP) benefits following a federal judge’s decision that prevented the administration from withholding the funds.

Known as FoodShare in Wisconsin, the SNAP benefits had been stalled during the recent government shutdown. However, late last week, the Supreme Court temporarily sided with the Trump administration’s request to halt the release of these benefits, prompting the U.S. Department of Agriculture to instruct states to “immediately undo” their issuance of full SNAP benefits.

During a visit to the WAFER Food Pantry in La Crosse, Gov. Evers emphasized that Wisconsin complied with the judge’s ruling in distributing the aid. He also criticized the Trump administration’s appeal to the Supreme Court to intervene, asserting, “That’s embarrassing for any president of the United States, whether it’s Donald Trump or somebody else, to be clawing something back that first of all, they know is their obligation, and second of all, a court said they should do that.”

Wisconsin, along with other states, has petitioned a federal judge to enforce the directive that the Trump administration disburses all benefits. According to a letter filed last week, the state risks exceeding its available funds for reimbursing grocery stores and retailers without federal support.

The state’s Department of Health Services has reminded grocery stores and retailers that they cannot refuse service to FoodShare recipients with account funds. Any issues with denied transactions can be reported to the state’s consumer protection hotline at 800-422-7128 or via email at DATCPHotline@wi.gov.

The uncertainty regarding SNAP has placed additional strain on Wisconsin’s food banks and service providers. Taylor Haley, board president of WAFER Food Pantry, noted a sharp rise in individuals seeking assistance, with the pantry now assisting an average of 10 new people daily, compared to less than two previously. “There is a lot of uncertainty,” Haley stated. “There’s a lot of fear that, in my mind, is needless.” He credited the La Crosse community for stepping up with donations to help meet the increased demand.
