Significant Changes in Immigration Detention Policies Under Scrutiny in Nevada
In a significant shift, a recent court decision in Nevada has challenged the rigid immigration policies implemented last year under the Trump administration. These policies mandated that all immigrants entering the U.S. without inspection be detained without the option for release during their legal proceedings, which can extend over several months or even years.
Sadmira Ramic, lead attorney for the ACLU of Nevada, criticized these measures, expressing concerns over the violation of due process rights. “Estamos hablando de personas que han vivido aquí durante décadas y que no tienen antecedentes penales significativos, obligadas a pasar tiempo en prisión mientras su caso civil, su caso migratorio, avanza,” Ramic stated. “Eso puede quebrar a las personas. Puede obligarlas a simplemente querer rendirse y decir: ‘Quiero ser deportado’”.
The recent court ruling now allows detained immigrants in Nevada the right to request a bond hearing, enabling them to return home while their cases are resolved. This development has already positively impacted two individuals represented by the ACLU: a DACA recipient and an immigrant crime victim.
The next steps involve informing eligible immigrants about their right to a bond hearing and ensuring the ruling’s statewide implementation. Similar legal challenges are underway in several other states, potentially signaling broader changes to immigration detention practices.
