Changes in Nebraska’s SNAP Program: Soda and Energy Drinks Back on the Menu

Nebraska officials have announced a policy shift that will permit individuals receiving food assistance to purchase soda and energy drinks once more. This change follows a recent court decision that affects multiple states.

Last month, the U.S. District Court for the District of Columbia invalidated waivers granted to Nebraska and four other states. These waivers, which had been sanctioned by the U.S. Department of Agriculture (USDA), restricted the use of Supplemental Nutrition Assistance Program (SNAP) benefits for buying sugary beverages.

The court’s decision, delivered by Judge Amy Berman Jackson, highlighted that the USDA had depended on an incorrect section of the law, overlooked a congressional definition of food, and neglected to solicit public feedback before implementing these limitations.

Nebraska was a pioneer in adopting this waiver, which was implemented on January 1, with strong support from Governor Jim Pillen. At the time, Gov. Pillen justified the restrictions by stating, “There’s absolutely zero reason for taxpayers to be subsidizing purchases of soda and energy drinks. SNAP is intended to help families access nutritious food, and there’s nothing healthy about what we are removing through this waiver.”

Following the court’s ruling, the Nebraska Department of Health and Human Services has begun collaborating with retailers across the state to lift the restrictions on soda and energy drinks for SNAP beneficiaries.
