Nebraska’s Medical Cannabis Law Faces Implementation Hurdles Despite Voter Approval

Despite the federal ban on marijuana, Nebraskans voted in favor of medical cannabis in 2024. Yet, access remains limited, much to the frustration of residents and lawmakers. State Senator Danielle Conrad has expressed disappointment over the sluggish progress, noting the gap between voter intent and legislative action.

“The people are way out in front of the Legislature in Nebraska on this. And despite these decisive votes two years ago, we’re still really limping along in ensuring access to medical cannabis in this state,” Conrad remarked.

Criticism has been directed at the state’s Medical Cannabis Commission for its slow approach to implementing the new law. A major concern raised by lawmakers, including Cavanaugh, is that the current system may deter doctors from participating. This reluctance could further stall the availability of medical cannabis in the state.

“There is a real possibility that these dispensaries will have no doctors on the registry, meaning the commission will issue four grow licenses and a bunch of dispensary licenses and some manufacturing licenses, and then no one will be able to go to the dispensary and get cannabis, because there will be no doctors registered with the dispensaries, meaning there will be no doctors that can make a recommendation in state of Nebraska, because doctors are afraid that if they did that, they would potentially lose their license,” Cavanaugh explained.

While some Nebraskans have managed to obtain medical cannabis by seeking recommendations outside the state, this solution is not feasible for everyone. Cavanaugh highlighted that those most in need—such as patients with mobility challenges—are often unable to travel for treatment.

“The people who are not able to get access to medical cannabis in Nebraska are the patients who have mobility issues, the patients who are disabled and can’t travel. And that’s really what this bill is trying to answer, is the sickest patients are the ones who can’t get cannabis right now,” he stated.
