Former Nebraska Sheriff Faces Jail Time and Probation Over Missing Firearms
In a case that has drawn significant attention in Nebraska, a former sheriff has been sentenced to a combination of jail time and probation following the disappearance of firearms from his department.
Clinton J. Smith, aged 43, received his sentence on Thursday at the Dundy County District Court. He faced a reduced charge of attempted possession of a stolen firearm, categorized as a class 3A felony. This sentencing followed an agreement with prosecutors, which led to the dismissal of a second charge initially filed for theft valued between $500 and $1,500.
The court’s decision mandates Smith to serve 90 days in jail alongside 48 months of probation. The initial 45 days of his sentence are to be served immediately, while the remaining period may be waived by the probation office contingent upon Smith’s satisfactory completion of his probation term.
Additionally, Smith is required to pay restitution amounting to $474.75.
Earlier in 2023, Smith was removed from his position as sheriff after voters overwhelmingly supported a recall election. Following his removal, he was obliged to return all departmental equipment and firearms.
An affidavit submitted in District Court revealed that an investigator from the Nebraska State Patrol discovered that four Glock pistols were missing from the storage room of the department. The newly appointed Dundy County Sheriff encountered this discrepancy.
When questioned about the missing pistols, Smith reportedly denied any knowledge of their location.
Subsequent investigations by the Nebraska State Patrol led to the discovery of one of the missing firearms at Smith’s residence in Benklemen.
These findings resulted in Smith’s arrest on charges of theft by unlawful taking and possession of a stolen firearm.
